Citizen's Group Intervenes in Anam/Helzer Lawsuit Anne Graham-Bergin, the attorney for Pinal Citizens for Sustainable Communities (PCSC), has yet to confirm whether or not Pinal County will defend their acceptance of a referendum challenging the rezoning for the Willow Springs project. The landowner and the wife of a Pinal County Planning & Development employee have challenged the referendum in a lawsuit. PCSC, an Oracle-based organization, has requested to be a party to the case and the plaintiffs have agreed. Intervention by PCSC means that the group would have standing in the case and could defend any aspect of the case that Pinal County government chose not to defend. The rezoning, sought by the landowner, a Canadian-based corporation named Anam Inc., was unanimously approved by the Pinal County Board of Supervisors May 16. On July 2, PCSC submitted nearly 6,000 signatures challenging the rezoning of over 7 square miles of land for the first phase of Willow Springs, a proposed residential housing project planned to cover over 18,000 acres with about 34,000 houses about 10 miles north of Oracle Junction. On July 12 Pinal County Elections department, acting on the advice of Bill McLean, Pinal County Deputy Attorney, accepted the petitions. On July 25, Anam and Elaine Helzer sued Pinal County Elections Department seeking to invalidate the signatures. Helzer is an Oracle resident who recently formed a group supporting the landowner. Helzer's group, partially funded by Anam, has been adamant in their support of the decision by Pinal County officials to approve the Anam rezoning request. According to Bergin, Anam and Helzer may now seek move the venue for their lawsuit out of Pinal County to a neighboring county, perhaps Graham or Pima. If Pinal County chooses to defend their acceptance of the referendum, Judge Boyd Johnson will decide the issue based on material submitted by plaintiff's Anam and Helzer and the defendants, Pinal County and PCSC. Unless Johnson finds that material facts are at issue in the case, there will be no oral argument by the attorneys. |
